OnArcher provides an AI-powered SBA loan marketplace platform that connects small business owners and mortgage brokers with SBA lenders. Our Services include:
• ARCHI: Our AI assistant that guides users through the pre-qualification process
• Financial Analysis: Automated DSCR calculations and business financial assessment
• Document Management: Secure collection and storage of financial documents
• Lender Matching: Connecting qualified applicants with appropriate SBA lenders
• Application Tracking: Real-time status updates throughout the loan process

  1. User Accounts

To use certain features of our Services, you must create an account. You agree to:
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

When using our Services, you agree to:
• Provide truthful and accurate financial information
• Upload only authentic documents that belong to you or your business
• Not misrepresent your identity, business status, or financial condition
• Not use the Services for any fraudulent or illegal purpose
• Comply with all applicable laws and regulations

  1. Pre-Qualification Disclaimer

Important: Pre-qualification is NOT a guarantee of loan approval.

Pre-qualification through OnArcher provides an estimate of your potential loan eligibility based on the information you provide. Final lending decisions are made solely by participating SBA lenders based on their own underwriting criteria, a complete review of your application, and verification of all submitted information.

Pre-qualification amounts may differ from final approved amounts. Interest rates, terms, and conditions quoted during pre-qualification are estimates and subject to change based on the lender’s final determination.

  1. Intellectual Property

All content, features, and functionality of OnArcher—including but not limited to ARCHI, our proprietary algorithms, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof—are owned by OnArcher, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

  1. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ONARCHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM:
• Your use of or inability to use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content
• Loan approval or final lending decisions made by participating lenders or SBA

  1. Indemnification

You agree to indemnify, defend, and hold harmless OnArcher and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another party.

  1. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our platform prior to the changes taking effect. Your continued use of the Services after any such changes constitutes your acceptance of the modified Terms.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the federal or state courts located in Delaware.
